SECTION 1 - WHAT DO WE DO WITH YOUR INFORMATION?
When you purchase something from our store, as part of the buying and selling process, we collect the personal information you give us such as your name, address, phone number and email address. By making a purchase, you consent to receive marketing and promotional emails from BondiBoost. We may use your first name only and location to re-market information that you have recently purchased from our store. By downloading an eBook from our store, as part of the download process, we collect your email address. You agree to opt into marketing and promotional emails when you download an eBook. When you browse our store, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system.
Text Marketing Terms and Conditions:
We are using a text messaging platform, which is subject to the following terms and conditions. By opting-in for our text marketing and notifications in, you agree to these terms and conditions. By entering your phone number in the checkout and initialising a purchase, subscribing via our subscription form or a keyword, you agree that we may send you text notifications (for your order, including abandoned cart reminders) and text marketing offers. You acknowledge that consent is not a condition for any purchase. This data will be used for sending you targeted marketing messages and notifications. Upon sending the text messages, your phone number will be passed to a text messages operator to fulfill their delivery. If you wish to unsubscribe from receiving text marketing messages and notifications reply with STOP to any mobile message sent from us or use the unsubscribe link we provided you with in any of our messages. You understand and agree that alternative methods of opting out, such as using alternative words or requests will not be accounted as a reasonable means of opting out. If you wish to opt out please follow the procedures above.
SECTION 2 - CONSENT
How do you get my consent?
When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only and you consent to your first name and suburb being used to re-market your most recent purchase on our website.
How do I withdraw my consent?
If after you opt-in, you change your mind, you may withdraw your consent for us to contact you, for the continued collection, use or disclosure of your information, at anytime, by contacting us at Hello@bondiBoost.com.au
SECTION 3 - DISCLOSURE
We may disclose your personal information if we are required by law to do so or if you violate our Terms of Service.
SECTION 4 - PAYMENT
Your payment is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.
All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover.
PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.
SECTION 5 - THIRD-PARTY SERVICES
In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.
However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.
For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers.
In particular, remember that certain providers may be located in or have facilities that are located a different jurisdiction than either you or us. So if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.
As an example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, then your personal information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act.
Once you leave our store’s website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service.
Text messaging originator opt-in data and consent will not be shared with any third parties.

SECTION 6 - SECURITY
To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.
If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption. Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.

AI Hair Quiz:
Bondi Boost has adopted this Biometric Data Policy and Notice (this “Policy”) to govern the treatment of our customers’ and site users’ Biometric Data. Compliance and acceptance of this Policy is mandatory to proceed. This Policy (together with our Terms Of Use and Privacy and any other documents referred to on it) sets out the basis for how Biometric Data collected from you, or that you provide to Bondi Boost, may be processed. Please read the following carefully to understand our views and practices regarding your biometric information and how it will be treated.
1. BIOMETRIC DATA
Bondi Boost may collect data and information that potentially falls under the definitions of “biometric identifiers” or “biometric information” as defined under the Texas Capture or Use of Biometric Identifier Act (“CUBI”), Bus. & Com. § 503.001 et seq., or other similar state or federal statute.
“Biometric Identifiers” are defined as retina or iris scans or imagery, fingerprints, voiceprints, or scans of the hand or face geometry from which an identifier template, such as a faceprint, a minutiae template, or a voiceprint, can be extracted. Biometric Identifiers do not include: writing samples or signatures, photographs, hum biological samples, demographic data, physical descriptions, or information collected, used or stored for healthcare treatment.
“Biometric Information,” means any information, regardless of how it is captured, converted, stored, or shared, based on an individual’s biometric identifiers that is used to identify an individual.
“Biometric Data,” as used herein means Biometric Identifiers and Biometric Information.
2. BONDI BOOST’S USE OF BIOMETRIC DATA
Collection of Biometric Data is for the purpose of developing your personalized hair score when using Bondi Boost’s AI Hair Quiz. Biometric Data may also be utilized for features of our website that require live facial recognition through your device’s camera to access programs requiring biometric authentication.
If you consent to our collection of Biometric Data, you agree that we may collect a scan of the facial geometry, for example around your hairline to allow us to develop your personalized hair score when using Bondi Boost’s AI Hair Quiz. Note that we do NOT collect your iris, retina, or any other information for the purpose of identifying you in the real world. Your Biometric Data may be shared with our service providers solely to operate the service.
3. HOW WE COLLECT BIOMETRIC DATA
Biometric Data may be collected by Bondi Boost through live facial recognition by giving Bondi Boost access to your device’s camera, or through uploading a selfie.
If you use Bondi Boost’s AI Hair Quiz, it will allow the application to take a photo of your face by providing access to your device’s camera.
4. RETENTION OF BIOMETRIC DATA
Only the amount of Biometric Data necessary for the specified purposes will be collected. Bondi Boost does not connect your Biometric Information to your personal identity.
Bondi Boost shall retain any Biometric Identifiers and/or Biometric Information for the limited period-of-time required to provide you with the desired service(s).
5. SECURITY MEASURES FOR BIOMETRIC DATA
Bondi Boost uses appropriate technical and organizational safeguards to transmit and protect from disclosure Biometric Data that is collected from unauthorized access, loss, or misuse, including, when applicable, encryption and access controls.
6. OUR COMMITMENT TO PRIVACY
Bondi Boost will not disclose or disseminate any Biometric Data to any entity, other than those contracted parties that assist Bondi Boost in providing the service(s), or as required by applicable federal, state or local law, or required pursuant to a valid warrant or subpoena issued by a court of competent jurisdiction, for example:
· We will share your biometric identifiers and/or biometric information with contracted parties that assist us in providing service(s) to you;
· We will share your biometric identifiers and/or biometric information where it is required by applicable federal, state, or local law; and
· We will share your biometric identifiers and/or biometric information where it is required pursuant to a valid warrant or subpoena issued by a court of competent jurisdiction.
7. CONSENT TO USE BIOMETRIC DATA
Biometric Data will only be collected by Bondi Boost with your prior explicit consent. Before using Bondi Boost’s AI Hair Quiz or any other biometric authentication, you will be prompted with a copy of this Policy. By clicking “accept” you are acknowledging that you have read and understood this Policy and are explicitly consenting to our collection, use and storage of your Biometric Data as described herein. Further, your acceptance of this Policy shall be deemed your confirmation that you are over the age of 18 and otherwise able to consent to this Policy.
8. YOUR RIGHTS
Depending on the state in which you reside, you may have certain privacy rights regarding your Biometric Data. Residents of Illinois should refer to the Illinois Biometric Information Privacy Act, 740 ILCS § 14/1 et seq. and residence of Texas should refer to CUBI. For other state residents, we encourage you to check on your state’s Biometric Data privacy rights, including (if applicable for your state):
· Your right to know what Biometric Data is collected, why, and how it is used.
· Your right to request access to your Biometric Data.
· Your right to request deletion of your Biometric Data.
· Your right to opt-out of the collection, use, or sale of Biometric Data, as permitted by law.
